General Terms and Conditions for Independent Salespersons

Preamble

These General Terms and Conditions for Independent Salespersons (GTCS) apply to all transactions carried out between Waifly Host and the independent salesperson.

Object

These GTCS define the terms of collaboration between Waifly Host and the independent salesperson.

Status of the Salesperson

The salesperson acts as an independent contractor and is not an employee of the company. He is responsible for his own social and tax charges.

Missions of the Salesperson

• Prospect new customers.
• Present and sell the company's products/services.
• Ensure customer and sales follow-up.

Remuneration

• The salesperson receives a 10% commission on each sale made. (company fees deducted (PayPal or Stripe))
• For rentals, a 10% commission is paid for each payment made by the customer. (company fees deducted (PayPal or Stripe))

Payment Terms

• Commissions are paid monthly, upon presentation of a sales and payment statement.
• Commissions will be paid via PayPal or bank transfer.

Salesperson's Obligations

• Respect the company's image and values.
• Do not disclose confidential information.
• Use the sales materials provided by the company.

Duration and Termination

The contract is concluded for an indefinite period. It may be terminated by either party without notice, unless a commission is pending, in which case the notice period is the time until the next payment date.

Disputes

In the event of a dispute, the parties undertake to seek an amicable solution. Failing that, the dispute will be submitted to the competent jurisdiction.

Applicable Law

These GTCS are governed by French law.

Modification of the GTCS

Waifly Host reserves the right to modify these GTCS at any time. The salesperson will be informed of any changes.
