These GTCS define the conditions under which Waifly sells web hosting services and priority administrative review services to its customers.
Waifly offers the following digital services:
Prices are shown in euros (€), inclusive of all taxes (TTC). Payment is due immediately upon ordering. Waifly uses secure third-party payment processors; no banking data is stored on our servers.
Subscriptions are automatically renewed. Users may cancel at any time via their dashboard. Termination will be effective at the end of the current paid billing period. No pro-rata refunds are provided for voluntary cancellations.
Waifly reserves the right to modify prices with a 14-day prior notice via email.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content not supplied on a tangible medium whose execution has begun after the consumer's express prior agreement and express waiver of their right of withdrawal.
By checking the required box before payment, the user requests immediate execution of the service and expressly waives their 14-day right of withdrawal. Administrative fees for Priority Manual Reviews are non-refundable once the investigation has started.
In the event of a permanent cessation of activity, Waifly will notify users 30 days in advance. Current subscriptions will be honored until their expiry. If a service must be interrupted before the end of the paid period, a pro-rata refund will be issued for the remaining days.
Waifly undertakes to provide services with reasonable care. However, liability is limited to the total amount paid by the user during the last 12 months. Waifly is not responsible for service interruptions caused by third-party providers or user misconfiguration.
Data is collected only for billing and service management purposes in compliance with the GDPR. Users can exercise their rights of access and deletion by contacting contact@waifly.com.
These GTCS are governed by French law. In case of dispute, and after a failed written claim to support, the courts of Tarascon, France, shall have exclusive jurisdiction.
